These Terms of Service (“Terms”) govern the use of HondoGO’s electric vehicle (EV) fast-charging services (“Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using the Services.

1. Contractual Relationship

By accessing or using HondoGO’s Services, you (“User”) agree to the terms, conditions, and notices provided in this document. These Terms form a legally binding agreement between you and HondoGO. If you do not agree with any part of these Terms, you should not use the Services.

2. Eligibility

To use HondoGO’s Services, you must:

• Be at least 18      years of age or the legal age of majority in your jurisdiction.
• Provide      accurate and complete registration information.
• Create a user      account (“Account”) on the HondoGO platform.
• Have a valid      payment method on file if you are purchasing charging services or other      products.

3. Account Registration

When you create an Account, you must provide accurate, current, and complete information, including but not limited to, name, address, phone number, and payment details. You agree to update this information if any of your details change. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your Account. You agree to notify HondoGO immediately of any unauthorized use of your Account or any other breach of security.

4. Charging Services

HondoGO provides EV charging services at designated charging stations. By using these charging stations, you agree to:

• Follow all      operational instructions and safety protocols displayed at the charging      station.
• Pay for the use      of the charging services as specified by HondoGO, either through our      website, mobile app, or other authorized methods.
• Ensure that the      vehicle being charged is compatible with the charging station’s      specifications.
• Not engage in      any illegal, hazardous, or disruptive behavior while using the charging      stations.
• Abide by any      additional rules and regulations at the location of the charging station.

5. Payment Terms

Charges for the use of our Services are calculated based on the current rates posted on our website or mobile app. Payment is due immediately upon completion of each transaction, and you authorize HondoGO to charge the payment method associated with your Account. If your payment method is declined or fails to process, we may suspend your access to the Services.

6. Modifications and Termination of Service

HondoGO reserves the right to modify, suspend, or terminate any portion of the Services at any time, including updates, improvements, or discontinuation of specific charging stations or service areas.

We may also suspend or terminate your Account if you violate these Terms, engage in fraud, or fail to make payments. Upon termination, you remain responsible for any outstanding payments.

7. Privacy Policy

Your use of our Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully to understand how we collect, use, and protect your personal information.

8. User Conduct

You agree that you will not:

• Interfere with      or disrupt the operation of the Services.
• Use the      Services for any illegal or unlawful purposes.
• Attempt to      hack, decompile, reverse engineer, or otherwise access HondoGO’s      proprietary software or infrastructure.
• Violate any      applicable laws, regulations, or the rules and policies of any property      hosting a HondoGO station.

9. Limitations of Liability

To the maximum extent permitted by law, HondoGO is not liable for:

• Any indirect,      incidental, special, consequential, or punitive damages.
• Loss of data,      business interruptions, or any other financial loss.
• Damage to your      vehicle, personal injury, or loss of life resulting from the use of our      charging services.
• Actions of      third parties, including other users or parties associated with property      owners hosting our charging stations.

10. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to participate in class action lawsuits, and the location of arbitration will be in Stamford, CT unless otherwise agreed.

11. Indemnification

You agree to indemnify, defend, and hold harmless HondoGO, its affiliates, officers, employees, and partners from any claim, loss, liability, or damage, including attorney fees, resulting from your use of the Services or your violation of these Terms.

12. Force Majeure

HondoGO shall not be held liable for any delay or failure to provide the Services due to events beyond its reasonable control, including but not limited to, natural disasters, war, terrorism, governmental actions, labor disputes, or technical failures.

13. Intellectual Property

All content, software, logos, trademarks, and other intellectual property associated with HondoGO and the Services are owned by HondoGO or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to use, copy, or distribute these materials without explicit permission.

14. Updates to Terms

HondoGO may update these Terms from time to time. Any changes will be posted on our website, and the revised Terms will become effective immediately upon posting. By continuing to use the Services, you accept the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of [jurisdiction], without regard to its conflict of law principles.
